    Hello, I have a court date tomorrow, July 30 regarding an eviction. This house is in foreclosure. The house once belong to my exwife, during the divorce I was granted the home as part of the divorce. However, my exwife refuse to sign the documents from the bank note. I must point out that she did sign over the Deed. I was approved for a loan for a mortgage but again my exwife would not sign the bank note allowing me to purchase the home. What are my options in court... also no payment has been made on the mortgage in nearly a year.

    It's not clear what papers your ex refused to sign, but the fact remains that payments are in arrears. I don't see anything in what you have said which would stop the foreclosure.

    No, you should have continued to pay the loan if you were given the house. If she would not sign, you take her back to court and they order her to sign or be found in contempt.

    So basically you made errors in not paying the mortgage, ( you could have keep paying it for years till it was paid off if you wanted, since the deed was already signed over to you)
