    I have a residential lease from October 29, 2008 to Oct 29 2009. Landlord lives out of the country. I have continued to pay the rent monthly. There is an addendum to the contract that says that I should notify my intention of vacate 45 days before lease expiration. Also add. Says that landlord and tenant agree to renew the lease for another year within the same price ant terms

    So, you did not move in Oct of 09. Therefore the lease renewed for another 12 months instead of converting to a month to month. So if you move now, you will be responsible for the rental until 10/29, 2010 or until the landlord has a new tenant.

    Yes every Oct the leave renews if you don't give notice 45 days before.

    Both answers are spot on so its your move. Leaving early, even with notice, does not allow you to stop paying rent. The 45 day notice applies for next September 15th. If you don't give notice by then you have another year long lease. Ask the owner if he will release you early with a financial incentive to him, maybe a month or two rent.
