    This is a legal question so has been moved to the appropriate Law forum.

    It is legal in almost all states for the owner of a dwelling unit to evict a resident of that dwelling unit who is not an owner. However, a spouse is entitled to remain in the marital home until the resolution of a divorce proceeding. So if her were to try to evict, you could point out to the court that there is a pending divorce action and the eviction order would be dismissed.
