    Abandoment custody??
    Before I joined the Army in '99, I had my son all the time. The mother only came around when it was beneficial for her. So I enlisted into the Army in '99 and my parents took over on the responsibilities of my son. As time went by, my son's mother just dropped all contact all together. I'm currently working on getting my son back which will not be an issue with my parents, but I need to know what to do about my son's mother as I do not know where she is. And what type of custody will it be, legal, physical etc... Any help will be greatly appreciated.

    It would appear that you HAVE custody by virtue of having your son - of, rather, having your parents care for him on your behalf. If you want to file for sole custody and exclude the mother the Court will attempt to locate and notify her.

    I'm not sure you want to do that.

    I've asked that this be moved to the legal board.
