How can we get our car back?
My partner john decided to swap his car with his mate ash to see if they liked the cars. They wrote on a piece of scrappy paper that they had swapped, the paper never said it was permanent. My partner decided he does not want the car so he told ash who said "well the cars mine now, you swapped, your problem". We've been trying for days to get the car back but he won't give in. He says "ive registered the car in my name" which we know is NOT true as we still have the v5 and my partner never gave permission to the dvla to re-register the car. We went to the police station who said "the piece of paper is not a legal document, he must give the car back, try talking to him if he still says no call this number". We called the number who said "tell him if he doesnt give it back he will get arrested. He also said an officer can go to his house to tell him to give the car back. We told him but he still wont budge. We went to the police station and the officer said "nothing to do with us go to the c.a.b". We decided to call the number again who said get a solicitor to write him a letter. It seems everywhere we go we get different info and get sent to another place. What can we do because we are stuck with a car not suitable for us as we have a 8month old baby.

Go to the police again and file a stolen vehicle complaint. Or, if you have a copy of the keys, go to where the car is leave his and drive home in yours.

One police officer says because of the paper we can't say its stolen,
Another says we can because he it not taking it without permission and unfortunately we have no other key

The paper would normally prevent your claiming it was stolen. However, if you have documented that you have asked for its return and he refuses, a stolen car charge might fly.

Yeah we have plenty of texts on my partners phone with him saying I'm not giving it back so I guess were just going to have to try everything we can. Its just putting so much stress on us at the moment we need that car back
