    Marriage fraud.
    Ok Im not to sure where to start so ill just get to the main part,

    My sons mother got my signature under false pretences. She needed my signature in order to move to the states. She started to not obey the settlement so I brought her back to court. With out my signature she would not have been able to leave and hse didn't intend on honoring the settlement until I brought her back to court.

    She met a man in strip club she was 25 he was 40
    She married him 5 months later
    When she received her Green card and resident status she continued to be wish washy with our settlement as still wasn't obeying it.
    She actually only live with him 7 months and my son has just told me that they are no longer living together.

    Son tells me mom says he is bad, crazy, really jealous too much info for a 4 year old to know.

    Also says he pushed her and she pushed back

    My question is If she is no longer living with him and has her own place with lease can I report it as a fraud marriage cause that what it was.. All she wanted was her status when she got it she stuck around for 7 more months and left.

    In our settlement she is supposed to give me 60 days notice of where she plans on moving. She moved and she doesn't know that I know. Ive hired someone to prove that she is residing in her own place.

    If someone wanted to try and scam is there a limit to how long they have to stay together?

    Now that there not together wouldn't she be deported?

    My son is canadian I am american, His green card is going to expire soon same with his passport. She tried to get me to resign his passport and I refused because I'm scared I will not see my son again if she is given free mobility.

    With out the new passport will she be able to get my son a new green card?
    All I want is my son back home, all of his family is here and he was only living there for the past 7 months in which I have had to fly back and forth to pick him up.

    There is no reason for her to be in the USA if she is no longer with this man so how can I get my son back home?

    I can only answer on the immigration questions.

    It sounds like a bad marriage, not a fraud marriage. If so, there is no grounds for revocation of permanent residence or deportation. If she divorces now and can prove up the bona fides of the marriage, she will get her 10 year PR card well before the 2 year CR time.

    Your sons US permanent residence does not expire, just the card. His passport is not required to file the renewal of the card.

    Sounds like a bad situation all around. Good luck.

    She stuc around for 7 months and now lives on her own.

    Umm sounds like she did it to get her american residency and soon eventually try and become a citizen. She pressured me to help her before we split and she left for this guy.

    Things are not always like what you described.. why don't you leave the immigration issue to USCIS? If she can prove she entered marriage in good faith, and then became victim of domestic violence, she will be qualified for 10 yr permanent resident.

    Why not just be nice to each other, at least for the kid... be a good parent.

    My child has no Business being in a dif country.. Only reason he was allowed to move was because hse got married. Im sorry for wanting to be a father to my son. She has played every trick in the book to get where she is at. THIS IS me trying to be a good parent and get my son back where he is safe and surrounded by family
