    Plaintiff asking for continuance
    I have been sued in Justice Court by a debt collector over an alleged credit card debt. I filed a response and a pre-trial conference was scheduled for July 26. Now the debt collector has asked for a 60 day continuance in order to gather the evidence they need. Would it be wise for me to file an objection to the continuance on the grounds that they have already had enough time to get their case together?

    If you have the time, sure, file an objection. My feeling is that you will be denied because they will have "proof" that they need more time.

    Of course, if they need more time because they cannot locate the paperwork hopefully they won't find it in another 60 days.

    If you file an objection you won't be gaining anything as it will probably be denied anyway.

    Chances are pretty good if they don't have the documents now that they won't have the documents in 60 days or 60 years. Just sit tight and wait.
