    How can my ex get away with strangling me?
    My ex and I got into an argument and it escalated into him putting me into a choke-hold until I could not breath. Once I dropped the cell phone he was after he dropped me and ran out the front door. I was four months pregnant at the time. I had a neighbor call 911. When the police caught up with my ex, he told them that all he did was put his arm around my neck and he twisted my other arm behind my back and that's how he got me to drop the phone.
    He has plead not guilty to the charge and a jury trial has been set.
    I did go to the emergency room two days later when the pain became unbearable and my ear started to hurt. I also had to see an ear, nose, and throat specialist for the damage the strangulation had done to my throat and ear.
    My question is... With my testimoney and the medical records, what are the chances of him being found not-guilty during jury trial?

    I feel badly about what happened to you!

    No one here can predict what might happen in court. However, did he use his hands around your neck to choke you?

    Thank you, and no he did not use his hands. He used his whole arm. The police told me it is called a choke hold. He came from behind me and wrapped his arm around my neck.

    I would think then, that no matter how the hold was, that the medical evidence would indicate as to how the injuries were sustained.

    Have you been told anything by officials as to that effect, please?

    Not at all. I was told at the emergency room that only 20% of all strangulation's leave marks and/or bruising. So the pictures the police officers took shouldn't help his case.
    I am releasing my medical records to the District Attorney in hopes that it will help with their case.
    I don't know how I would handle him getting away with strangling me. I keep thinking, what if he gets full rights to my child and hurts my child.

    Hello new:

    Putting his hands on you IS the crime. He told the cops he did it. You say he did it. The medical evidence says he did it. I'd say the probability of conviction is 98%.

    Thank You excon. Just hearing the biast opinions of my friends is not enough for me. To hear the opinion of someone not involved at all really helps. I appreciate your reply. Thanks again.

    If you did suffer injuries and have the medical records in the DA's hands chances are very good that he will be convicted. He may or may not do any jail time though but be put on probation during which time he will probably screw up and end up in jail anyway for VOP. (we can only hope he screws up).

    Sounds like the electric chair isn't good enough for this jerk in my eyes.
