    I was arrested for drug possession. The state of GA has never prosicuted me.
    What should I do if Ga arrested me and never prosecuted me? The statue of limitation has expired. Can I sue the state of GA for my items that were taken? My car was taken, my computer, a diamond necklace, and about a thousand dollars in cash and other items. What should I do?

    Hello k:

    If the criminal statute of limitations expired, the civil one most likely did too. I'd move on. Just be happy they didn't prosecute.

    Keep in mind, the federal statute of limitations most likely HASN'T expired, and if you piss the cops off, they can turn the case over to them..

    First if you were arrested ( that means you were charged correct ?) or did the DA drop the charges brought by the police at the arrest.

    Normally at the arrest you are charged, that stops the statue of limiation, they are free to go years to take you to trial if they want and you don't file for a speedy trial.

    Most likely your case was not that important and/or just fell between the tracks. Here in GA it is not uncommon to always take about 12 to 18 months to get to trial, and I have seen it take years. I have not been a officer for about 5 years and I still have one case I may have to testify for if it ever gets to trial.
