The fact that you have parental rights, means that you are responsible for what the child does and the where abouts of that child at all times, as you say you hold responsibility.

Obviously you have been awarded this responsibility by the courts and the rights of the father would also have been laid down.

It would seem that he has not kept to his part of the courts decision, therefore you must return to court via your solicitor/lawyer stating the problems with the current arrangement to get things back on track.

I'm sure there will be many reason why your child was not returned home,with an apology stating that this will not happen again ( I'm sure it will ), for the safety of your child and your own peace of mind the best thing for all concerned is to sort it out legally, then there can be no mis-interpretation of what he can or cannot do.

My problem here is you are using unusual terms. Every parent has "parental responsibility". The general term is custody. When the parents do not live together, one is the custodial parent the other is the non custodial parent. Which is which is generally determined by a court order with the NCP given a visitation schedule.

So, to advise you what to do we need to know whether there are existing court orders awarding you primary custody. We also need to know your general area to know what laws apply and it might help to know how old the child is.
