In a word - no, you can't terminate his rights.

As a side issue why do you want to terminate his rights? He's obviously not exercising them anyway.

What does the Court Order about child support say (you do have a Court order, right?)?

He is not required to pay support unless you have a court order for child support ( do you have one ?)

Is he on the birth certificate ?

Do you have a custody order ?

In general he is not asking for or using any of his rights ?
Does he even have a order for visits ?

But no you can't just get his rights taken away for this
