I will be on supervised probation till oct. 2010 and he is deploying in April 2010. I have paid off all my fines, I just mail in a paper every month. Can I still get a passport and move there for three years? If I can't can he change his orders so that he can stay here until I'm off?

Not without the permission of your parole officer.

You can always get a passport - it's a federal form of ID.

I doubt very much that the Army will postpone your husband's tour until you get off probation. It's the Army, not the Boy Scouts.

Is he in Germany already? You said he is deploying there in April 2010. This is July.

Since this is NOT a what if, you need to provide certainty for your family. It's available. It's just not available here. First off, you need to speak with your PO about your proposed move. That's where it's available. He may LET you go. He may not. It's only a few months. I'd call him today

I agree with my friend, Judy. The army isn't going to accommodate you.

But, if he's being deployed in April... April already happened.

No probation officer? The DA supervises? What?

You have a someone who is supervising your probation, you may not know who it is, but there is someone. The court, the person you mail to every month. But you can not go out of state without their permission in most cases, So you will have to get permission to move out of state,

And no the Army will not change his orders for this reason

So, you are on probation until 2011 or does he deploy in 2011? Which is it?

In any event chances are slim to none that you will have the Army accommodate you and your needs. Chances are better if you formally request to be terminated from probation early. Ask. Who knows, it may just happen. Your reason is you want to leave the country legally for 3 years and live in Germany with your husband. The sooner you ask, the sooner you'll get your answer.
