I fail to see what the question is. Like Fr_Chuck pointed out, he is allowed visitation - that doesn't mean he's required to use it. There's not really anything more required at this point.

There is no question asked. What is it you want to know?

Because of this will the courts allow him to have unsupervised when we go back on the 19th? It has been over 10 weeks since he has tried to see our daughter and she is only 18 months. Is this grounds enough to keep him on supervised?
    Sorry, I am not

Is this grounds to keep him on supervised visitation, or when we go back to court do you think the judge will drop this? It has been 11+ weeks since he has seen his daughter and she is only 18 months.

No, this is NOT grounds to keep hm from having unsupervised visitatation in NY. I'm a little confused because you were giving advice on this same subject on another thread.

You can ASK that visitation be supervised, not be overnight or anything else - it is up to the Judge to determine what is in the best interest of the child. I do agree that 18 months is very young for overnight visitation; however, I've seen it awarded.
