I don't know what to do I am 30 and have two kids both 2years old not and I'm not married me and my girl friend fight a lot and recieny she cut me with a metal spacila and chipped my bone and cut tindens and nives and now I can't work for 6 to 7 months I have moved out but I want my kids to live with me and don't know what to do she is crazy she tried to kill her self once and I called 911 but they did nothing to help she is a pot smoker and drinks has lost her right to drive and never stays home with the kids she tould wellfair she has not seen me in a year told them I don't support the kids at all but I was living thear at the time now I need some assistance and can't get it with out telling them the truth idont know what to do should I press charges on her have her put in jail or what?

How long ago did she cut you?
Why aren't you going to family court to prove she is a threat and get custody of the kids?

She told Welfare you didn't live with her and therefore she collected full Welfare benefits? I can see why you don't want to go to the Police with this.

If she is as "crazy" as you say you need to file in Court for custody because SOMEBODY needs to protect the children. You will need to prove your allegations.

And go to the Police about your injuries.

Let's start with the first question: have you been established as the legal father of these children? Was a court-ordered DNA test done or did you sign a paternity acknowledgment? If not, then you need to take those steps before you can do anything.

Did you call the police when she allegedly attacked you? Was a report filed? Were any charges pressed against her?

I'm curious - when did she start drinking and smoking marijuana? Before or after the children?

What do you mean by "I need some assistance and can't get it without telling them the truth"? You're applying for welfare and trying to figure out how to receive benefits when she has lied and told them you weren't around? Aren't you already using the benefits she receives?

She cut me about a month ago well I've been staying there idont have a home to go to and now I can't work so what do I do with two kids?

Okay, here's the first problem. This woman was a drug-user prior to having children. You chose to stay with her, she became pregnant, and now you want to point the finger at her for something you were previously willing to overlook. That doesn't work.

Second, if you didn't call the police when she assaulted you, then there's no proof of physical violence on her part. It's going to sound like bitter accusations in an attempt to obtain primary custody.

Third, I still don't know what you mean by "I'd tell them the truth about it all." You do realize that she was obtaining benefits by fraudulently completing paperwork... correct? This means YOU will be in trouble too, not just her - you were part of that household and you knew what she was doing.
