    Internal Agency Employment Law.
    Teacher broke up fight in south Bronx... 10 years ago.. was found guilty of pushing a child during the fight. Loss of livelihood.

    Teacher was won the right to a hearing de novo in New York Supreme Court. The municipality refuses to produce the child for cross. Child is now in her majority.

    You can subpoena them as a witness if you like. If they don't show wouldn't that strengthen your case?

    Agree with both of my colleagues - I don't know what the question is but the teacher's case is stronger without the child as a witness.

    And, of course, there's always the power of a subpoena.

    Why the 10 year hiatus? Why wasn't this case brought forth long ago? I don't think you'll prevail being that the case is 10 years old now.
