I have been trying to research what rights a Colorado unmarried mother has to take her child out of a verbally abusive home and move back in with her parents in another state, but I'm not finding much helpful information... mostly only on divorcées. Would this be considered kidnapping? What are her rights and what would be the smartest way to go about things? (FYI: there are no current or pending court orders... they have never been to court or filed any papers.)

Most of the same information applies to your case as it does in other cases. If you don't seek custody first and ask to move. There is the possibility that if the bio dad goes to court seeking custody you may be FORCED to return with the child or relinquish the child to the father. Do it right and start the paperwork now if that's what your wanting to do.

You are rude and don't want to hear the truth,

If you move and the father does nothing, you are OK.

If you move the father can file for custody and file to force you to move back to that state to allow him visits.

So if you move before getting a court order, it is your risk.
