How to put a lean on a house
My so called friend owes me 56000 his father recently past and in his will left it to him his brother and sister. In Jan of 2010 the brother got the father to sign a paper stating that my friend gets nothing upon the fathers death because my friend owes the father 400000 Well the house is sold and settlement will be next month and the brother says my friend will not get any of the proceeds thus meaning I won't get paid. This brother had power of attorney of the father for the last two years because he could not handle his own affairs. Do you think the paper the father signed in Jan to change the will can stand up in court? Is there any way I can put a lean on the house to try and get the money due me? Thanks Tony

Not a chance. You have no claim against the house since the person who owes you the money never had and won't have an interest in it. Even if you were to sue your friend and get a judgment, it wouldn't help because he has no interest in the house.

Also, whatever the father signed to disown your friend also has nothing to do with you. If your friend wants to challenge he can try, but you have nothing to do with it.

The "father" did not owe you, and unless the person that owes you, inherits the property, or gets the money you have no claim to it
