What is sentecing for attempted murder
Hello H:
It depends on what state it happened in.

IT was in Indiana, he is 17, being charged as a adult. No past criminal history, possible mental health issues at play. We are hoping that the charges will get dropped to a lower charge, but we don't know. Can't afford private attorney, he has a public defender. Attacked girlfriend in argument.
Hello again, H:
Then I'm not going to indulge the prosecutor and scare you further. Suffice to say, if he's convicted of ANYTHING, it's not going to be good.
So his (and your) job now, is to avoid conviction at all costs. If the case has already proceeded to the point where he has an attorney, he should listen to him. This IS a question for his attorney, and that's who he should ask.

PS> Public Defenders are GOOD attorneys.
Lawyer is trying to go the "insanity" route, at least temporarily, due to his past mental health issues, but Im not so confident of this, as I don't think it is too successful. The victim is not pressing charges at this time, it is the state pursuing it. What he needs is intensive inpatient treatment, but not sure he will get any treatment at all. So frustrated.
The trouble with mental health is that you have to be at a point that you did not know what you were doing is wrong, most crazy people still know what they are doing is wrong.
Victim does not have to press any charges, the DA will threaten them to testify in court.
The court and the system does not get him treatment, if you could afford treatment, then a private facility could be a deal.
I will be blunt, most of the state prisons are nicer than the state mental health hospitals. And even there not sure what level of treatment ( more housing at times) he will get.
So what treatment was he taking or getting before this happened,
Sentence could be as much as 15 to 20 years, with about 1/2 being served before parole. If he does have mental health issues most prison systems have mental health wards in some of their major prisons.
He was supposed to be taking antidepressants , but took himself off them. When he lived here , he was in counseling and meds.
I can't believe that the charges would be so stiff, w/ someone w/ no criminal history. What are the chances of charges getting reduced to something less? Assault w/ deadly weapon. I think that they will go for the attempted murder. He is in the process of psych evals right now. I don't know they can tell his state of mind at the time of the crime. He has told me that he doesn't remember hardly anything, like he blacked out.
