    Court summons and judgements
    I am being sued from an agency that has collected a substantial debt from a hospital, for medical services rendered. I need to file a written responsse but do not have the $400 to do so and will not be able to come up with it in the allotted time frame. Now, I was just going to let them put a judgment against me in court because I am working with an agency to pay off my debt with debt settlement... what I am wondering, is if I do not file a response, what wsill happen? Will they just put a default judgment against me? Will there be any other consequences? I will definitely show up in court, I just do not have the money to file a piece of paper. Is a default judgement any different then if I had filed the response and went to court and still got a judgement against me?

    First of all, who said you need $400 to file a written response?

    If you do not respond, a default judgment will be placed against you - depending on your state laws, the plaintiff will be awarded the cost of the judgment, interest, and possibly any attorneys and/or court fees.

    Let's say that you were going to file a response with the court - what would it be? What would your defense be for not paying the debt?

    Your best option would be to contact the collection agency and try to arrange a payment plan with them because once they have a judgment, they do not need to "work" with you anymore and your chance at having the amount reduced is gone.
