    Adoption in Virginia
    My son's father has already stated he will relinquish his parental rights but because I moved from West Virginia to Virginia for more than 6 months, I could no longer use the lawyer I was using because he was not licensed in VA. I couldn't used him for the relinquishment or the adoption I had planned to have soon after my husband and I were married (we are currently married as of April). I would like to avoid using a lawyer if at all possible. I have been told to go to the courthouse but never really told who I should talk to when I get there. I want to get this process moving because he is breathing down my neck to get this paperwork finished, mainly because he pays support for 2 children currently (my child and one from another marriage). I just need to know what department of the courthouse I should speak to and what kind of forms I am going to have to request, if possible. Any help in this matter would be greatly appreciated! Thank you in advance.

    In most states you have to be married for at least a year before they allow an adoption like that because there has to be grounds for stability. Also doing an adoption without a lawyer at your side really isn't a good option. What state is the child support order out of? Is he still in that state?

    Which county? They might just have forms and information online.

    If not, it's just a matter of asking in the court clerk's office.

    The father resides in WV, I reside in VA. He lives in mononghalia county and I live in Alexandria City (it's considered a county). The order is out of WV for child support but I am responsible for doing the paperwork and filing it for the relinquishment of rights. I was told that the adoption would most likely go through without a hitch because of my husband's income and the stability it provides.

    I looked for the forms you might need here. There are a lot of them and, sorry to say, I couldn't find what you need, with the exception of form DC 680. You might want to have a look for the forms and instructions as well.
