If your baby's last name is the legitimate father's last name, his name will still remain on the birth certificate and you will have to prove to a judge it is in the child's best interest for the name change. However, you don't say whose name you want to change it to, your own perhaps. There is a kit you can purchase from your local court office to make this happen, but it all depends whose name is on the birth certificate to start with.
