I have a 10 month old daughter. Her father has not seen her or tried to establish contact for over 6 months, and for the first 4 months he disappeared for 36 days of that.. He has paid only $100 in child support for the whole pregnancy and life of my child, and is not on the birth certificate. I was told he was doing drugs so since I told him 6 months ago he could not watch her till he passed a drug test he has since disappeared. I just want to be able to file something so that he does not have rights and cannot file for custody... someone told me to file for abandonment.. is that possible and if so when can I file? I live in CO.

No its not possible. You can't file for something that doesn't exist. If you want court ordered custody then go to court for it. Also get child support set at that time. The courts are going to request a DNA test so he can be decalared the legal father.

What is it you actually want? What do you think abandonment would do for you? Why is he not on the birth certificate?
