    Texas reinstate parental rights
    I would like to know if a parental rights can be reinstated after 5 years. There are two children involved, H - 15 years old (died Sept 30, 2009) and C 14 years old. The aunt on the father's side has had custody of twice now. Once from jan 2001 through oct 2003, cps step in when H got alcohol poison. Then the courts put both of the children back in her custody in March 2008 and May 2008. Since the death of H, I feel that I should have some kind of right to have my parental rights reinstated, because of the death, so that C can be protected. If there are any suggests please let me know. My daughter says that she would like to live with me. I have all the things that she needs to be here with me.     Probably not.

    It is EXTREMELY difficult to overturn a TPR. You don't mention whether you voluntarily relinquished or if it was involuntarily taken from you. If it was the latter, you can give up right now. You'll never win in court if you had your rights severed and just NOW are looking to get them back, after 5 years.

    If you voluntarily relinquished--well, almost the only way to overturn is to PROVE that you were coerced. Again--the 5 year wait is going to work very badly against you.
