    I have a summons for Tuesday for fieri facias but I own nothing what should I do?
    I have a summons to answer interrogatories and writ of fieri facias, from Glasser and Glasser, for Capital one. I just tried to settle with them but they were not interested. They offered me a payment plan of $50 a month for 6 months. And then they would reevaluate for increase. On the exact amount owed. I don't have this $. My credit is already shot. And I was told to never pay one payment if you don't plan on paying them all because this starts you back at day one for a write off. I have no bank accounts. No houses (except the one in foreclosure ) no cars not owned by the bank. No job . I live in my mother in laws house. What can they do to me if I have nothing?

    Is there a Judgment against you? If NOT, yes, making a payment extends the Statute.

    It sounds like there IS a Judgment.

    Then you have no choice but to respond with the requested info - the life of a Judgment can be 20 years and the creditor is trusting that within the next 20 years you will find employment.

    But other than waiting for me to get employment, they can't do anything else can they? I mean I've never been sued by a creditor before. And I'm not young. Is Capital one doing this to everyone? I mean my bill was only like 2700.00 before all this started. Now they want like 3500.$$ In the myst of losing my house I really didn't think of Capital one at all. Had bigger problems at the moment, guess they were just waiting to swoop in.

    Let me know what happened I have a summons for tomorrow and I can tell you what I did but this is all new

    Most likely the bill will be closer to 4 or 5 thousand. Once they go to court for judgement they add the interest and late fees, then they will add legal and court fees after going to get a judgement,
    A 3000 dollar debt going in should easily be 6000 or more after court.

    Next they will just wait, if you inherit any money in the next 20 years, if you finally go to work and so on.

    Yes Fr_Chuck is right and they will continue to call and send you letters until the judgement is satisfied. I know of a person that owed capital one $800.00 and this person let it go to a default judgement and by the time everything was said and done he ended up oweing them over $3000.00! So it does add up quickley.
