    I am a mother, if I give up rights to my child, do I still have to pay child support
    I have seen this question before but it is never for my state or it's always a father asking? I would like to give up my rights over my son, to his biological father. I live in Florida. And have had physical custody of my child for the last 6 years. His biological father owes me about 26,000 in child support. When I give up my rights will I still have to start paying child support.

    Yes, you are still entitled to the back support, why are you going to give custody to a man who would not even pay support ?

    Is there more to this story ?

    Why have you not taken him back to court, or got child support enforcement after him ?

    The answer is no different whether you are the mother or the father. The laws refer to "parent".

    You will not be allowed to give up your rights. Only a court can terminate parental rights. And they will not do so to clear the way for an adoption. They will never do so to allow a parent to get out of paying support.

    You can relinquish your custody to the father, but if he petitions the court for child support, you will be required to pay. You may get a credit of what he owes towards what you have to pay.
