If the biological parents of a child give you power of attorney and then they leave and no body has heard from them in three weeks, how do I go about getting full custody of the child? I am wanting to adopt the child and they have made no contact since giving me power of attorney.

From a birthmother's point of view--you're awfully hasty about taking someone's child away from them.

Okay it said that I had to give a brief description so I did. The story is this... They have two children, a two year old girl that they left with family and the 11 month old that I am asking about. They said that they did not plan the 11month old but they did their little girl. The birthmothers step mom has foster children so she could not take the 11month old. They left him with me. I know that they were having problem with drugs and said that they were going to go to Texas and set up house and that they would be back for the little girl. I also know that they did catch a bus to houston, but since then no one has heard from them. Her step mom is filling for the little girl, but I want the 11 month old boy. I thought since I already have power of attorney, I would be able to get full custody. I just want to know the legal way to do it. I have been searching on here for the past two days. It may seem hasty, but knowing the environment that these kids were in was what made it hasty. I have proof that they left the 11 month old with who ever would watch him and where he was staying, and I am here to tell you that it was no place for even a dog to live in. With all of my proof and knowing that they did in fact leave and have not made contact or even tried to make contact, I am thinking that they just do not want the child, and I do. I don't see how anyone can just leave a child somewhere and not even ask about them. Does this help you to help answer my question?

I also think that before making a statement on how hasty someone is that you should also know the facts. I have known the child from the time he was two months old, and I have seen so much that I have pictures of and video of. I am not just wanting to tear apart a family. I am trying to give this little guy a family. I would not be writing this if I wasn't sincere and honest.

Have you contacted CPS? That NEEDS to be your first step.

To adopt a child not related to you, you generally need to go through a home study, and be approved to adopt.

You may want to contact an attorney in your area, because the whole situation is strange--and because it really HASN'T been that long since the parents left, and they DID leave provision (POA) for someone to care for their children.

If the parents do not have a record with CPS, it's going to be MUCH more difficult to take the child(ren) from them.

Child protective services is where I am going next. Thank you for your advice, I also think that once I show the video and pictures that I have it may be easier.
