    My daughter just had a baby with her ex-boyfriend in Florida is there a website that gives information on rights of "custodial" and "non-custodial" parent. I understand that basically right now they both have legal custody... And if not under what pretenses would you file for sole custody... it is unclear but I don't believe it is just handed out.. they are both young, inmature and love to assume what their rights are and what they can restrain each other from doing or not doing... Any help would be greatly appreciated trying to keep the peace... my grandbaby would be more at ease without the constant bickering. Thanks.

    They don't both have "legal custody" - the mother has custody. The father has rights but he cannot exercise them without her consent until the Court proves paternity and specifies/orders his rights. If she doesn't want him to see the baby, for example, he can't - she is in control.

    Sole custody? I doubt it. I see joint custody with HER being the live-in (custodial) parent and HIM having visitation rights. Is she going to Court for child support?

    There are many angles and issues here - what is your exact concern, please?

    The Court will determine (after evaluating the situation and the parties) what is in the best interest of the child.
