    I have a lawsuit filed against me
    I live in Illinois and have a lawsuit filed against me from a collection agency for a CC debt. I am unemployed but have set up payments with them anyway. They are taking directly from my bank account. Will they still seek a judgment?

    They couldn't do this without having a judgement against you. So they already have a judgment that's why they can take money out of your account.

    Hello

    Are you saying you set up payments and gave them the bank information to take payments out so you can catch up on this debt or as noted above do you have a judgement which gives them the right to take out the money in your account? If you do have a judgement would it not be a smart idea not to put money in that account knowing they will wipe you clean?

    I set up payments with the collector before the lawsuit has gone to trial. As of yet they have not served me with a summons to appear in court. I don't know if because I am making payments they will continue with the suit. All this is a mystery to me at this time. Gosh I hate dealing with collectors! Thanks for your answers!

    Did you get this payment agreement in writing? ALWAYS GET AN AGREEMENT IN WRITING

    If you gave them your bank info (a bad idea), they may not pursue a judgment. But usually they do so they can fall back on the judgment if you stop paying.
