I live in Texas and have a question regarding child custody laws. In Texas, any man may sign a birth certificate without proof of paternity. If a person signs a birth certificate claiming a child as his and the biological father doesn't argue or fight for custody, what rights does the biological father have later if he changes his mind regarding custody and child support of the child? Would the person who signed the birth certificate have to relinquish his rights to be given to the biological father or would it be a given right and taken from the one who signed?

How far down the road are you talking? Which ever person is on the because is the legal father until proven otherwise. So, the bio dad would have no rights or responsibilities for the child. With that said if he does want them then he goes to court and gets the court to order a DNA test to prove he is the father then the because would be changed and he wold then be both the legal and bio father.

There is 4 years statute of limitation in Tx
