    How soon can I post a three day notice in Florida
    When the rent is due on the 1st day of the month and it is not paid, how soon can I post the three day notice? Can I post it on the 2nd? How long do I have to wait to deliver or post the 3 day notice?

    You can file as soon as the rent is late - if it's due on the 1st and not paid, you can post on the 2nd.

    I do have a late fee stated in the lease if not paid by the 3rd
    I do have a late fee stated in the lease if the rent is not paid by the 3rd of the month

    They're not the same issue. Give them a 3 day notice at 12:01 AM on the 2nd, and charge them a late fee after the 3rd.

    Are they historically late ? Are you wanting to evict them for some other specific reason.

    Normally most landlords don't try to post notice so soon. They enjoy making that extra money from late fees. Not joking, when I owed all of my rental properties I almost hoped everyone was 5 days late, so I would make so much extra money each month.

    Yes, this Tenant has violated the lease by being aggessive to everyone in the complex. This will be a much easier eviction then going the other route. I have lost good Tenants over her behavior.
