    What rights do I have when I took over remaining months in lease from father
    My brother and I is subleasing from our father for the remainder of the original lease. There are significant property damage such as holes in the wall caused by his tantrums and marker scribbled all over by his son. I will be solely taking over the lease this June. Can I sue my brother for property damage if he does not fix the walls before he left as promised?

    So you and your brother were subleasing a residence from your father. Now your brother wants out, but has damaged the property.

    If the landlord charges you for the damages, then you can sue your brother for those costs. But since you are not the landlord, you have to wait until then. Unless you pay to repair the damages yourself. In which case you need to document the damages.
