    Mother died &willed assets to stepfather, he died, do I have any right to moms assets
    I live in Florida. My mom died 1.5 years ago and left all her assets to my step-father. He died 4 months ago. I think he had a will because there is a bill for his funeral recorded at the clerks office that indicates "will on probate". We were not on good terms and I feel that my mother was pressured into leaving all her assets to him before she died. Do I have any right to the part that was my mothers assets?

    If your mother had a valid Will and directed that her entire estate pass to her husband it then became his to dispose of as he wished - and if there had been no Will it would be distributed among HIS survivors. You are not one of his survivors.

    I had personal experience with this issue sometime back, where my mother left her assets to her sister, her sister died and willed the assets to another sister who also died leaving everything to the children of her then husband. The sequence of events is essentially that once your mother willed her assets to her husband they became his assets and will be administered in accordance with his will. That's extrapolation based on personal experience. Just thought I would share it with you. Maybe someone with legal experience will pick up on your question and provide a more definitive response.

    This is a legal issue not a health issue so it has been moved to the proper forum.

    If you think there is a will, go to probate court and request to see a copy.
