I had an affair with a married man and had a child. I ended the affair because I knew it was wrong. He wanted to keep our son a secret from his wife, so we agreed to stay out of court. He pays monthly but doesn't see or spend time with him. When I got laid off, I lost my private health insurance and had to apply for medicade. I just received a letter from social services that they are going to pursue him for medical support and asked if I wanted child support. He doesn't have any assets in his name not even his vehicle. If I sought support would his wife's income be a factor and would she have to pay if he can't?

Actually that should not even be a worry or concern, you should go after child support, they are going after money for any welfare you will get so his wife will find out now. So do what you should have done then, get the proper amount of support, It will be based on his income.

Household income is considered for support. But payment will be his responsibility.

Hey scott, sorry if this is considered hijacking, but it pertains to this woman's post directly. She said that they asked if she wanted child support. But they never gave me an option. I was told it was manditory. I'm in Arizona.

In most states, if the state has to pay public assistance for a child where there is a father who can pay support, they will go after that father for support.

Not all states use household income either. Mine is one that does not it would only be his income so knowing what state this is in would be a great advantage. In most (well all states that I know of) if government assistance is needed it will be sought but which party collects the money changes. Some states the support goes directly to the state to help repay the benefits the cp is getting. Other states (again like mine) the support payments go to the NCP but that counts as income for the ncp so the benefits collected would be less, not always by much it depends on how much is ordered and coming in.

No,I don't see "household" income used in child support guidelines.

If he falls behind and begins accruing arrears,the CSE may be able to come after any joint assets they have to get those arrears paid.
