I have been in prison for 6 out of the past 7 years of my sons life. The mother of my son doesn't allow me to visit my son or speak with him. I have come to the conclusion to where I'm considering filing what's required to terminate my parental rights. I have been sending 100 dollars a month although I am unemployed and have been for the past 10 months and now am being threatened to be incarcerated again due to late payments of child support. My question is in the state of Florida will I still have to continue to pay child support after legally terminating my parental rights

1. you can't just give up your rights anyway, so the rest of this has no real meaning after that.

2. why have you not went back to court to lower your support amount, it would be less than 100 dollars if you are unemployed with no job.

3. you ex can not stop you from seeing your son, if you get your rights to visit enforced. That is from your child visitation order you got in court.

And if somehow you were able to give up your rights ( and you can't) yes you will still pay child support

Please pay more attention to posting guidelines. There is a Read First sticky in the Children forum (where this was moved from) that directs questions of a legal nature to this forum.

Had you looked in the Family Law forum you would have found another sticky that refers to termination of rights. You can't give up your rights. Only a court can terminate rights and usually only in narrowly defined circumstances. Also a court will not issue a TPR just to let a parent out of paying support. So you need to approach this differently. File for a modification of the support and visitation orders.
