I just moved into a duplex.
I have a TV in my bedroom that is watched very seldom. It is located on a shared wall (Landlords bedroom) directly above the cable access as it comes through the wood floor.
When first looking at Apt I was told by landlord that no sound transfers between apts.
Last week I went to bedroom around 1030 pm to lay down and finish watching a show.
I passed out with TV on volume 15(quite low) and woke up about 1pm to turn it off.
I had received 3 text messages from 1230 on. The first stating that she could hear my TV, 2nd that she was going to sleep on the couch and 3 that I was very inconsiderate for put a TV on a shared wall and she never had a problem in 10 years
I was not notified previously about problem.
In addition I am affected by many of her daily activities
I feel like I have to walk on eggshells now and want out of my lease.
Am I being harassed? Is this against the law?

I don't see this as harassment. She has notified you that your loud TV has disturbed her sleep.

You passed out?

If you want to get out of your lease, ask her to lt you out - she may very well agree. If not, you will have to buy it out (pay for months when you are not there).

It is not allowed in a private rental house if your TV was really bothering the person next to you. I called the police last night on my next door neighbor at 3 am because their TV or radio was too loud and bothering my sleep.

Why I wonder why she just did not knock on your door or call you, that would have been my action.

But a email is not wrong actually it is very nice. Pehaps you can just move the TV

Sorry - you didn't say you fell asleep. You said you passed out. I thought perhaps alcohol was involved.

Yes, the landlord can notify you in any manner she sees fit. I have no idea why she didn't simply tell you in person.

I am sure she was "over reacting" to losing a night sleep. Most likely if you talk to her, say you are sorry for it being too loud and do somehthing to not let it happen again, she will be OK

Yeah the night before the house next door was playing music not loud but audible and I heard her slam her window then a couple minutes later open the front door and yell out to the neighbor to close his window. Controlling issues?
What about the tenant right to quiet enjoyment of premises.

Most areas have a rule about quiet time, generally between 10 PM and 6AM. So playing the TV past 11, even if you thought it low, is violating the quiet time.

I also don't see any harassment here. I suggest you either move the TV or putting some tapestries or other sound deadening between the TV and the wall.

Yes, sounds like she wants people to respect quiet times. She should have merely called the police o people next door

I think that possibly the word both of you are searching for is "allowed".

I had the same problem with noice. I rent a room. I just brought a pair of wireless headphones. They cost about $15 & up and work great. You also can buy a set of regular(wired) headphones, anywhere from $5-$20+ and then buy extension cords so it can reach from the T.V to your bed. I got the extension cords (6ft ea.) at wal mart, about $5 ea. and the headphones at Big Lots or Fry's This works great. I can fall asleep, turn my T.V up as loud as I want and don't have to worry about disturbing anyone else. You can let your landlord know that that's what your going to do and that should put an end to that issue. I also don't see any harassment here, maybe a lack of maturity, and common sense on her part, slamming windows, yelling at people, multiple text's etc.etc. Oh, I knew you meant you fell asleep when you said you "passed out" :-) hang in there.
