My father is stubborn and won't wright a will, he feels he doesn't have too.He stated that when he passes he wants his granddaughter (my daughter) to have his home and belongings. His wife(my step mother) has alzheimers and has 3 grown children from prior marriages. I am an only child ( my mother passed way) and my father remarried 10 years ago. My father sold my mother and his home after he remarried and bought a home he deeded to his wife and grand daughter. And is getting ready to sell it to remove his wife off all propertys due to her illness. And he purchased a new home over a year ago.and deeded this one to only his self. The property has 2 homes on it. One which is my daughters and one my father lives in with his wife. My questions is... can the step children come in and demand a share if he passes away with no will? We live in the state of Maryland. Her children don't help with her. Our side of the family is the only ones who help with her.My step mother has never worked while married to my father and their were no children as a resought of this marriage. My daughter was the only miner child who lived in the house (she is now 26) and disabled. Remember the house is not deeded to his wife, so would the home be considered joint property?
