I live in New York and my ex and I have a baby... and we were in the middle of a custody battle he had a paternity test done behind my back and turns out he isn't the father... when my daughter was born he signed the birth certificate and acknowledgement of paternity... now he wants nothing to do with her... can I have him removed from her B.C and have her last name changed to mine?

It appears that you and your ex don't "have a baby." It appears that you have a baby and he does not and you attempted to convince him he was the father.
