A bank teller gave my husband a large amount of money from my passbook savings accout. My husband was only a beneficiary.. I want to the bank to complain and they told me I would have to get a police report and press charges on my husband... I will not do that but I do want my money bank and my husband used to pay a gambling debt. The supervisior told me they would give me money back after paper work is filled out but then they will go after my husband to get the money back? Do I have any rights? Did he have possession of the passbook at the time of the withdrawl from your account?

Yes, you have rights. YOU were not ripped off - the BANK was. Your deposit is insured against loss by the FDIC. I'd call the bank and inform them you are about to make a claim with them IF the money isn't put back in your account Monday morning when the bank opens.

Follow up your phone call with a certified letter saying the same thing. If there's no money on Monday, call the FDIC.

The bank should be held responsible for letting him have money out of your account! The teller was not paying attention or something, seems to me that the bank would have to put that money back and like excon said if they don't file a complaint ASAP

The prior advice is accurate. You can force the bank to restore the withdrawn funds. But the bank will, in all likelihood, swear out a fraud complaint against your husband.

Whether the bank goofed in letting your husband withdraw the money, he did, in fact, file for a withdrawal. The fact that the bank made a mistake does not free your husband from a fraud complaint.

So you have a choice, force the bank to restore the funds and risk your husband going to jail. Or let it go.
