    Inherited property disputes
    My mother passed away over twenty years ago, leaving her residential property to me and my two brothers. My older brother took control of the premises, refusing to sell, and ultimately renting to his issue, and later, my niece. He contends that the property is his because he's paid taxes and made repairs over the years, while maintaining absolute control, custody and possession.

    After your mothers death, what was done with the deed, was all three of your names put on the deed. What has been happening with the rent money has he been paying you your share

    So sue him in court for your share of past rents and get the ball moving

    I doubt that a court would agree with him. Sounds like it's owned in common by the three of you.

    Did your mom leave it to your and your brothers by a will? Was the will probated?
