I live in Maryland. My child was born in Maryland. I was unmarried at the time. My husband wants to adopt our 10 year old son. Here are the problems. I do not know the location of the biological father. I do not remember the address of where he lived the last time I had contact with him around 8-9 years ago. No Affidavit of Parentage was filed. Only his last name and Jr. or II is listed, since our son has the 3rd on his. The only difference in the rest of their names is my son has an additional middle name. I have been physically and financially taking care of my son. My husband has been helping me care for him since my son was 4 years old. The biological hasn't seen my son since he was 2 and had no interest in seeing him or doing for him. My question is what do we have to do in order for my hisband to adopt him?

You need the biological father's consent. The Court will order certain steps to attempt to notify the father and, if unsuccessful, will allow service by publication.

You will need an Attorney.

You cannot accomplish an adoption with notifying the father and, if he consents, obtaining his signature.
