What if I sent form 843 (for refund) to wrong address?
    Hi All,

I filed form 843 to request for social security tax refunds for year 2009 (I'm currently working on my OPT and they were held due to error).

I sent form 843 on 19th March to following address (which I think is not the right address, but I'm not sure):

    Department of the Treasury
    Internal Revenue Service Center
    Austin, TX 73301-0255

Whereas I sent my other form (1040) to:

    Department of the Treasury
    Internal Revenue Service
    Atlanta, GA 39901-0002

If Austin, TX is not the right address, can I re-send the 843 documents to Atlanta address? I have already passed 15th April deadline.

    Can anyone please help?

    Thanks,
    Gurmeet

What is the deadline for submitting Form 843?
    Hi All,

I want to claim for social security tax refund. They were held in error as I'm still working on my Optional Practical Training (OPT) period.

What is the deadline for submitting this (843) form, and if some one knows where should I send these. (I already received my tax returns from "Form 1040")

    Thanks,
    Gurmeet

For 2009 tax return, file Form 843 on or before April 15, 2013.

If you have filed Form 1040, you will not get back SS tax and Medicare tax.

    Hello Mr. Aggarwal,

Thanks you for your reply. Yes, I have sent my 1040 form in mid-March and have received the federal tax returns (online).

Can I file for social security refund for year 2009 (i.e. Form 843) next year with my other tax returns for year 2010? Thanks,

    Gurmeet

    Gurmeet:

First, you can fix the filing of Form 1040 by filing Form 1040X with a properly-prepared Form 1040NR plus Form 8843 attached. On the Form 1040X, request that your non-resident alien status be re-instated.

Once that is done, and the IRS accepts the amendment, then re-submit the Form 843/8316 to the IRS to the Philadelphia, PA IRS Center. You can get the address out of IRS Pub 519.
