On Mar. 3rd I went to court for possession of under 50 grams of a CDS in a motor vehicle in New Jersey. I was granted a conditional discharge, and on the papers, 12 months of supervisory treatment is checked, not the box for probation. What is the difference between probation and supervisory treatment, and it has been over a month since I had court. Nobody has contacted me since, so when does the 12 month start counting? From the day I had court, or do I have to meet with a probation officer before the time starts to count down, is it possible that I never get contacted by the state about these charges ever again?

Sounds like a program that is required to be completed, normally it is from the time you start the program. You need to contact your attorney if you have one, or the clerk of the court

The State never forgets... don't think they will. It is unfortunate- setting up supervised treatment is YOUR responsibility, so do not procrastinate. If you have another court date, be sure you get the treatment set up well before then. Your court papers should be all you need to get started. Contact the court to find out the steps to take, or call your community treatment providers with your information.

In court the judge told me that it was my responsibility, but when I went to the clerk of the court to make a payment I told her that I have not heard anything yet, and that I wanted to speak to someone who could help me get started, because that is what the judge told me to do when I agreed to the conditional discharge, and her response was "be on your best behavior" and she kept saying "I dont know why the judge tells you guys that you need to contact us, because there is nothing that we can do about it because probation is too busy and can't keep up" Just a little bit of background on this town, this town alone arrests more teens and young adults for possession of a CDS than the rest of the county combined, and they are notorious for arresting more people than they can handle.

Although I don't know, it's my GUESS that the supervision in question is COURT supervision. In MY state, it's administered by the Department of Corrections. After an initial interview, they determine whether it's to be supervised or UN supervised. In conjunction with this, a drug evaluation is usually ordered and the follow up treatment is based upon that evaluation.

Now, I don't expect YOUR program to like this one. In fact, like the clerk indicated, there might not even BE a program. Cool.

But, in the face of the bureaucratic confusion you're confronting, you need to protect yourself. I'd write a letter to the court outlining exactly what events took place and asking them for guidance. Send your letter certified, return receipt requested and send a copy to the prosecutor. That way, they can NEVER say you just blew them off.
