Can a legal document be changed after it is signed
I purchased a LEMON from Hyndia of Tallahassee. All the paperwork that I signed and left with a copy of has a different lendors (Hyndia Finance) name on it. I received a bill from a different lendor. I just called them and they said that Hyndia had scratched out the other name and wrote in their name. I asked them to fax me a copy of the paperwork. My copy is not altered or scratched out in any way. Is this legal, do I have a leg to stand on in returning this LEMON.

    Hello k:

You might.. But, probably NOT for the reasons you described. Now, I don't know what your contract says, but I'll bet it says something like they'll find a lender for you IF the one they listed somehow doesn't come through.

But, if you bought it from a dealer, and it's a lemon, you may have a shot. Is it a NEW car? When did you take delivery? Is there a warrantee? Did they have a chance to fix it?

Did the paper work ( most do with in house finance) give them the right to sell the contract to another lender.

And it does not matter who holds the note, the loan to them is the same, it is a loan and does not give you a right just to give it back. You have to follow the lemon laws of that state. ( normally will have to be a new car, not a used one

Your loan docs are evidence of your debt. The documents and the cash flow (your payments) are personal property of the lendor and can be sold to another lender. So getting out of your deal for rthis reason probably won't work but there may be lemon laws that could get you out because your car is a lemon
