    Can husband win custody of his daughter?
    My husbands daughter currently lives with her mother. Her mother is currently in trouble with the law for possession and dealing narcotics and another case for a dui separate years, she has come up dirty on a drug screen with probation. She has not went to court yet for her probation violations, but will soon be going. My husband has a court hearing for the custody already. Since then she has filed for my husband to have supervised visits with child, claims that he let the child get violated in our home. Even though this claim was about 10 months ago and child has come to our home every other weekend take a few because of her making other plans and just now files for protection. The issue has already been told by CPS that there was nothing that happened that wasn't normal in children. I'm not sure what is going to happen, I know that we have all the proof that she has a drug problem and still being on probation and knowing she could lose her children she still used drugs. What do you think will happen in court?

    Unfortunately, no one can predict what will happen in court. The judge is supposed to look at what is in the best interest of the child though. It doesn't sound like being with her mother could be in the child's best interest at this time. What do you mean the child was violated? And how old is the child?

    Claims by one side or the other happen all the time, and without proof normally they are not reconised. Be sure you have proof of all you claim of her to provide the courts.

    But fathers get custody all the time if they prove to be the better parent

    Also you can request that she gets supervised visittions until she is clean from drugs. Make sure you bring all that with you and don't overstate anything.
