I have a tenant that has not paid me for two months on a month to month agreement. What do I do to get him out of my house?

If you give him a 3 day pay or quit the clock restarts... and you are stuck with them a while longer.. I'd give them served with a 30 day notice to vacate and file for eviction for non-payment of rent, make sure you follow the law to the letter, then you can get paying renters in sooner. And don't take partial payment under any circumstances, accepting that implies agreement.
