    Maybe. But, it's not as simple as that. In most states, even though he may be mentally ill, he'd have to not have been able to tell the difference between right and wrong when the offense was committed. He's going to need a good lawyer, too.

    It will depend on the level of his mental illness. In many US states, as long as they know the difference between right and wrong, merely having a mental defect does not make any difference.

    There are mental health wards in all state prisons
