    Credits when filing 1040NR
    Can you get the Child tax credit, the child and dependent care credit, the EIC and the education credit if you would normally be due for it but the 1040NR might prevent it? Please let me know.

    I have a Taxpayer identification number, not a legal resident and do not have a SS number.

    For 2009, you CANNOT claim the Child Tax Credit unless you can claim the child as a dependent AND the child is a U.S. citizen.

    You CAN claim the Child and Dependent Care Credit if you qualify for the credit like a U.S. citizen, which essentially requires BOTH parents be workink or attending school.

    You are NOT eligible for the Earned Income Credit nor any of the education credits as a non-resident alien.
