after you get married, you would apply for the K-3 visa, for the spouse of a USC. This visa allows you to enter the US and apply of US permanent residence. Congratulations and good luck.

    Hi thanks for reply...
Do I have to be married before or can we arrange to get married but apply for application beforehand?? And also will the k-3 visa enable me to work to the usa?

    Thanks

You need to be married for the K-3. after you marry, your spouse must file the relative petition (I-130) and include the receipt notice when filing for the K-3 (I-129F).

If you are engaged, you can file for the K-1 as the fiancée of a USC. The K-1 requires that you marry within 90 days of entry to the US and then you file for permanent residence.

Yes, you can apply for employment authorization (EAD) after you enter the US either as a K-1 fiancée or a K-3 spouse. You will need to provide a copy of your I-94 annotated as a K-1 or K-3.

Hi thanks for your help! Few more questions... How easy is it to fill in the forms... do we need a lswyer or will it be easy enough do do it all ourselves. Also is it possible to make an appointment at the embassey to go and discuss what we would like to do.

    Thanks

You can file on your own, just follow all directions on the consulate website and the forms. Keep copies of everything and follow up.

The consulate generally isn't very helpful with advice, as they usually refer you to the website. If you do go there, have your fiancé go and ask for help from U.S. Citizen Services, rather than the IV section. This may be better. Good luck.

Im in a similar boat. My british fiancé is looking to come live here but we're getting married in England which makes it a little more complicated. Either a K3 or K1 visa. A K1 visa allows u to enter as his fiancé but you have to get married within 90days. K3 you already have to be married so I'd go with the K1. You're going to need a lot of money just to file the forms to become a permanent resident. The I-130 costs about $1000 and you need several other forms.

Research what you need to send in with your visas thoroughly. Im in the process of applying for the third of the same visa now because I was unaware of info I had to include with each.
