Married but live in different states
    Hi,
Anyone please help me with this tax question?

I got married on sept 2009. I lived and worked in NY for the entire year. And my husband lived in MD and worked there for the entire year. We file joint on Federal and how do we file with the states?

    Thank you in advance

As long as your husband had no NY source income and did not live in NY, you can file as Married Filing Separately on your NY return even though you are filing as Married Filing Jointly on your federal return. This way you report your income to NY, but your husband does not report his to NY. Same thing for your husband's tax return in MD.
