    L1VisaHolder married filing jointly + newborn
    Hi,

    I am L1B visa holder and worked in US in 2009 with my husband.
    We both have SSNs which are valid for work with DHA athorization.
    We lost our job in the beginning of February.
    Our child was born in August 2009 in US and he is obviously US citizen.
    We left US for to Ukraine on September 23 and both did not work in Ukraine up to the end of 2009.

    Now we are filing 2009 taxes as married filing jointly.

    The questions are:
    1. Do we qualify for the EIC?
    2. Do we qualify for the child tax credit?
    3. Do we qualify for the Work Pay Credit?
    4. Can we e-file and get a refund directly to our US bank account?

    Also our family AGI for 2009 was $13846.

    When did you enter the U.S. Did you file 2008 tax return?

    Yes, I did file taxes 2008. I entered the US on January 2007.

    For 2009 you can file joint return as residents and claim your child as dependent.
